TERMS AND CONDITIONS OF SALE

These Terms and Conditions of Sale (“Terms”) govern the sale of products through maison-nori.com to consumers.

They define the rights and obligations of Maison Nori and its customers in connection with distance purchases made through the website.

By placing an order, the customer confirms that they have read and accepted these Terms, without prejudice to any mandatory statutory rights that may apply.

1. SELLER INFORMATION

These Terms apply to sales concluded between Maison Nori and any individual acting as a consumer.

2. PRODUCTS

Maison Nori sells Japanese- and Japandi-inspired homeware and accessories, including incense holders, matcha accessories and ramen bowls.

The essential characteristics of each product are presented on its product page, including, where applicable, dimensions, materials, contents, colors and available variants.

Maison Nori takes reasonable care to ensure that product descriptions and images are accurate. Minor differences may nevertheless occur due to materials, finishes, manufacturing processes, lighting conditions during photography or screen settings.

Such differences do not necessarily constitute a lack of conformity where they do not affect the product’s essential characteristics or normal use.

Certain products may be prepared or made to order. This does not, by itself, mean that the product is personalized for the purposes of consumer withdrawal rights.

3. PRICES

The prices applicable are those displayed on the website at the time the order is placed.

Prices are shown in the currency made available to the customer according to the relevant country or market.

The total amount payable, including applicable taxes and charges collected by Maison Nori, is displayed before final confirmation of the order.

Shipping is free where this is stated on the website or during checkout.

Depending on the destination and applicable local rules, customs duties, import taxes or other charges may be payable without having been collected directly by Maison Nori at checkout. Where such amounts are legally due by the recipient, they remain subject to the rules of the destination country.

Maison Nori may change its prices at any time. Any later price change does not affect an order that has already been confirmed.

In the event of an obvious pricing or display error resulting in a price that is clearly inconsistent with the actual value of the product, Maison Nori may contact the customer to correct the situation or cancel the order and refund any amount already paid.

4. ORDERS

The customer selects the products they wish to purchase and adds them to the cart.

Before confirming the order, the customer is responsible for checking in particular:

  • the products ordered;

  • quantities;

  • selected variants;

  • shipping address;

  • billing address;

  • contact details;

  • total order amount.

The order is recorded once it has been confirmed and, where immediate payment is required, once payment authorization has been obtained.

An order confirmation is then sent electronically to the customer.

Maison Nori may refuse or cancel an order where legally permitted, including in cases of reasonable suspicion of fraud, refused payment, clearly incorrect information, or an obvious error affecting the price or availability of a product.

If Maison Nori cancels an order that has already been paid for, the corresponding amount will be refunded.

5. PAYMENT

The payment methods available are shown during checkout.

Unless otherwise stated, payment is due when the order is confirmed.

Transactions are processed through the payment providers made available on the Shopify store.

Maison Nori does not directly retain customers’ full payment card details.

6. AVAILABILITY

Products are offered subject to availability or to Maison Nori’s ability to prepare them under the conditions stated on the website.

If a product becomes unavailable after an order has been placed, Maison Nori will inform the customer as soon as reasonably possible.

Depending on the circumstances, Maison Nori may offer:

  • a revised delivery timeframe, subject to the customer’s agreement;

  • a replacement product, only with the customer’s agreement;

  • cancellation and refund of the affected product.

No substitute product will be imposed on the customer.

7. PREPARATION, DISPATCH AND DELIVERY

Information relating to preparation, dispatch and delivery times is provided on the website and, where available, before the order is confirmed.

Maison Nori products may be prepared to order.

Preparation and dispatch generally take place within the timeframe stated on the product page, currently indicated as 3 to 5 business days for the products concerned.

Delivery times depend in particular on the destination. Where a 7 to 15 day timeframe is displayed for a destination, this constitutes the delivery information communicated to the customer for that shipping zone, subject to any more specific information shown during checkout.

Where a more precise delivery time or date is communicated before the order is confirmed, that information takes precedence for the order concerned.

Where no specific delivery period has been agreed, the applicable statutory delivery rules remain in force.

The customer must provide a complete and accurate address that is accessible to the carrier.

If delivery cannot be completed because of an incorrect or incomplete address, absence of the recipient, or failure to collect the package where this is attributable to the customer, any costs associated with reshipping may be charged to the customer.

Where tracking is available, tracking information is communicated to the customer or made available through the order tracking service.

Tracking updates may be delayed by the carrier and do not, by themselves, guarantee a specific delivery date.

Risk of loss or damage passes to the consumer when they, or a third party designated by them other than the carrier, physically take possession of the goods, subject to any special statutory rules that may apply where the customer independently chooses a carrier not offered by Maison Nori.

8. LATE OR FAILED DELIVERY

Maison Nori undertakes to comply with the delivery date or timeframe communicated to the customer in accordance with applicable law.

If delivery does not take place within the agreed period, the consumer has the rights provided by applicable consumer law, including, where the relevant legal conditions are met, the right to request delivery within an additional reasonable period and then terminate the contract if delivery still does not occur.

Where the delivery date is an essential condition of the contract or where Maison Nori refuses to deliver the goods, the consumer may benefit from additional statutory remedies.

Where the contract is terminated for failure to deliver under applicable law, any amount due back to the consumer will be refunded within the legally required period.

9. STATUTORY RIGHT OF WITHDRAWAL

Where the statutory right of withdrawal applies, the consumer has 14 days from receipt of the goods by themselves or by a third party designated by them, other than the carrier, to notify Maison Nori of their decision to withdraw from the contract.

Where a single order includes several goods delivered separately, the withdrawal period begins in accordance with the applicable legal rules from receipt of the final item concerned.

The consumer does not need to provide a reason.

The consumer may also use the model withdrawal form provided at the end of these Terms.

Use of the model form is not mandatory.

Simply returning a product without first communicating the decision to withdraw does not, by itself, constitute valid exercise of the statutory right of withdrawal.

After notifying Maison Nori, the consumer must return the product within the applicable statutory period and no later than 14 days after that notification, unless a more favorable rule applies.

Direct return costs associated with a change of mind are borne by the customer where permitted by law and where the customer has been informed accordingly.

The consumer may handle the product only to the extent necessary to establish its nature, characteristics and proper functioning. The consumer may be liable for any loss in value resulting from handling beyond what is necessary for that purpose.

10. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply in situations expressly excluded by law.

This includes, where the statutory conditions are met, goods made to the consumer’s specifications or clearly personalized.

The fact that a standard Maison Nori product is prepared or made after the order is placed does not automatically remove the statutory right of withdrawal.

An exception applies only where the product or circumstances genuinely fall within one of the exclusions provided by law.

11. 30-DAY COMMERCIAL RETURN POLICY

In addition to the statutory right of withdrawal, Maison Nori offers a commercial return policy allowing customers to request the return of certain products within 30 days of receipt.

This commercial extension does not reduce or replace the consumer’s statutory withdrawal rights.

Once the statutory withdrawal period has expired, returns made solely under this commercial policy may be subject to the following conditions:

  • the product must be unused;

  • the product must be in its original condition;

  • the product must be complete;

  • accessories and protective components must be included;

  • proof of purchase must be available;

  • Maison Nori must be contacted before the item is returned.

Full details are provided in the Return and Refund Policy available on the website.

Return shipping costs following a change of mind are borne by the customer unless Maison Nori states otherwise.

Personalized products or goods specifically made according to the customer’s instructions may be excluded from this commercial return policy, without prejudice to any statutory rights relating to defects or lack of conformity.

12. REFUNDS FOLLOWING WITHDRAWAL

Where a consumer validly exercises the statutory right of withdrawal, Maison Nori will refund the amounts that must legally be reimbursed, including, where applicable, the cost of standard delivery.

Any additional delivery costs resulting from the customer’s express choice of a more expensive delivery method than the standard option offered do not have to be refunded beyond the cost of standard delivery.

The refund will be made within the applicable statutory period from the date Maison Nori is notified of the withdrawal.

Where permitted by law, Maison Nori may withhold the refund until the returned product has been received or until the consumer provides evidence that it has been sent back, whichever occurs first.

The refund will be made using the same payment method used for the original transaction unless the customer expressly agrees to another method that does not result in additional charges.

13. DAMAGED, DEFECTIVE OR NON-CONFORMING PRODUCTS

If a product arrives damaged, broken, defective, incomplete or different from the item ordered, the customer should contact Maison Nori as soon as possible at:

To facilitate processing, customers are encouraged to provide:

  • the order number;

  • a description of the issue;

  • photographs of the product;

  • photographs of the packaging and parcel where relevant.

This practical procedure does not limit any statutory guarantees or consumer rights.

Where a product is found to be defective or non-conforming under an applicable statutory guarantee, the consumer will not be required to bear the costs necessary to bring the goods into conformity.

14. STATUTORY GUARANTEES

Maison Nori is bound by the statutory guarantees applicable to products sold to consumers, including the French statutory guarantee of conformity and the statutory guarantee against hidden defects.

Statutory guarantee information

The consumer has a period of two years from delivery of the goods to request application of the statutory guarantee of conformity where a lack of conformity appears.

The statutory guarantee of conformity allows the consumer, in particular, to request repair or replacement of the product free of charge and without significant inconvenience, subject to the conditions and timeframes provided by applicable law.

Where the conditions laid down by law are met, the consumer may obtain a price reduction or terminate the contract, including where bringing the product into conformity is impossible, refused, excessively delayed, causes significant inconvenience or where the lack of conformity is sufficiently serious.

Where a product is repaired under the statutory guarantee of conformity, the remaining guarantee period benefits from any extension provided by law.

Where replacement is required in the circumstances provided by law following a request for repair, a new guarantee period may begin in accordance with applicable provisions.

Any period during which the product is unavailable because repair or replacement is required suspends the remaining guarantee period in the circumstances provided by law.

The consumer also benefits from the statutory guarantee against hidden defects under Articles 1641 and following of the French Civil Code. Subject to the applicable legal conditions, this guarantee may allow the consumer to keep the goods in exchange for a price reduction or return them in exchange for a refund.

These statutory guarantees apply independently of any commercial guarantee that may be offered.

15. ORDER CANCELLATION

Where an order has not yet been processed or dispatched, the customer may contact Maison Nori to request cancellation.

Maison Nori will make reasonable efforts to process the request before dispatch.

This commercial cancellation option does not reduce any statutory right of withdrawal available to the consumer where applicable.

16. LIABILITY

Maison Nori is responsible for the proper performance of its obligations in accordance with applicable law.

Maison Nori cannot, however, be held liable for damage resulting in particular from:

  • use of a product contrary to its intended purpose;

  • failure to follow safety or usage instructions;

  • modification of the product by the customer;

  • fault attributable to the customer;

  • an event qualifying as force majeure under applicable law.

Nothing in these Terms excludes or limits any mandatory consumer right or any liability that cannot legally be excluded.

17. PERSONAL DATA

Personal data collected in connection with orders is processed in accordance with the Privacy Policy available on maison-nori.com.

Such data may in particular be necessary to:

  • record and fulfill orders;

  • process payments;

  • arrange delivery and tracking;

  • manage return or customer service requests;

  • prevent fraud;

  • comply with Maison Nori’s legal obligations;

  • send marketing communications where the customer has validly consented.

18. COMPLAINTS

For any question or complaint relating to an order, customers may contact:

Maison Nori will seek an amicable solution wherever reasonably possible.

19. CONSUMER MEDIATION

After first submitting a written complaint to Maison Nori and where no satisfactory solution has been reached, the consumer may refer the matter free of charge to the consumer mediator appointed by Maison Nori, subject to the applicable admissibility requirements.

20. GOVERNING LAW AND DISPUTES

These Terms are governed by French law.

Where the customer is a consumer residing in another country, this choice of law does not deprive them of any mandatory consumer protection provisions applicable to their situation.

In the event of a dispute, Maison Nori and the customer are encouraged to seek an amicable resolution first.

The consumer retains the right to bring proceedings before the competent courts in accordance with applicable law.

21. CHANGES TO THESE TERMS

Maison Nori may amend these Terms to reflect legal, regulatory, technical or commercial developments.

The version applicable to an order is the version made available to the customer when the order is placed.

Any subsequent amendment does not alter the contractual terms applicable to an order that has already been concluded, unless otherwise required by law.
