These Terms and Conditions of Sale and Use govern access to maison-nori.com as well as orders placed with Maison Nori.
By browsing the website or placing an order, you agree to these terms. Please read them carefully before making any purchase.
1. SELLER INFORMATION

2. PURPOSE
Maison Nori primarily sells decorative objects and accessories inspired by Japan and Japandi aesthetics, including incense holders, matcha accessories and ramen bowls.
These terms define the rights and obligations of Maison Nori and its customers in connection with the online sale of these products.
3. ACCESS TO AND USE OF THE WEBSITE
You must use the website in accordance with applicable laws and for lawful purposes only.
In particular, you may not:

use the website for fraudulent purposes;

disrupt its operation or security;

introduce viruses, malware or any other harmful content;

automatically extract or reproduce a substantial portion of the website’s content;

use Maison Nori’s content, photographs, texts or graphic elements without authorization.
Maison Nori reserves the right to suspend or deny access to the website in the event of abusive use or use that violates these terms.
4. PRODUCTS
Maison Nori presents the essential characteristics of each product on its respective product page.
We make every effort to provide descriptions, dimensions, colors and photographs that are as accurate as possible. However, slight variations may occur due to:

lighting conditions during photography;

the customer’s screen settings.
Such variations do not necessarily constitute a defect where they do not affect the product’s essential characteristics or normal use.
Offers are valid while stocks last.
5. PRICES
The applicable prices are those displayed on the website at the time the order is placed.
Prices are shown in the currency offered to the customer according to their country or the applicable Shopify market. Any applicable shipping costs, taxes or duties are indicated before final confirmation of the order where they can be determined at that stage.
Maison Nori reserves the right to change its prices at any time. A price change does not affect an order that has already been confirmed.
In the event of an obvious pricing or display error, Maison Nori may cancel the order and fully refund any amounts paid.
6. ORDERS
The customer selects the products they wish to purchase and reviews the contents of their cart before proceeding to payment.
Before final confirmation, the customer must check in particular:

the products and quantities ordered;

the selected variants;

the shipping address;
-
the billing address;
-
their contact details;
-
the total amount of the order.
The order becomes final once payment has been validated and a confirmation email has been sent.
Maison Nori reserves the right to refuse or cancel an order in the event of:

refused or suspicious payment;

an obviously incorrect or incomplete address;

suspected fraud;
-
an obvious error regarding price or availability;
-
a previous unresolved dispute with the customer.
If Maison Nori cancels an order, any amounts collected will be refunded.
7. PAYMENT
Available payment methods are presented during checkout.
Payment is due at the time the order is placed. Transactions are processed by the payment providers made available through the Shopify store.
Maison Nori does not directly store customers’ full banking or payment card details.
8. DELIVERY
Available shipping zones, methods, costs and delivery times are indicated on the website or during checkout.
Unless otherwise stated, the delivery times provided are estimates. They include order processing and transit time.
The customer must provide a complete and accurate address. Maison Nori cannot be held liable for a delay or failed delivery caused by:

an incorrect or incomplete address;

the recipient’s absence;
-
failure to collect the parcel;
-
an error attributable to the carrier;
-
an exceptional event or circumstance beyond our control.
If a parcel is returned to Maison Nori because of an incorrect address, absence or failure to collect it, reshipment may be offered. The corresponding costs may be charged to the customer where the failed delivery is attributable to them.
The risk of loss or damage passes to the customer when they physically take possession of the product, subject to any mandatory legal provisions that may apply.
9. ORDER TRACKING
Where a tracking number is available, it is provided to the customer by email or through the dedicated tracking area.
Tracking information is provided by the carrier or tracking service provider. Updates may be delayed and do not constitute a guarantee of a specific delivery date.
10. RECEIPT AND DAMAGED PRODUCTS
Customers are encouraged to check the condition of the parcel and products upon receipt.
If a product is damaged, broken, defective or different from the item ordered, the customer should contact Maison Nori as soon as possible at:

the order number;

a precise description of the issue;

clear photographs of the product;
-
photographs of the packaging and parcel where these show signs of damage.
After reviewing the request, Maison Nori will offer an appropriate solution, such as a replacement, repair where possible, or a full or partial refund.
11. RETURNS, WITHDRAWAL AND REFUNDS
Detailed conditions relating to returns and refunds are set out in the Return and Refund Policy available on the website.
Maison Nori allows customers to request a return within a commercial period of 30 days from receipt, subject to compliance with the conditions set out in that policy.
For consumers benefiting from the European Union right of withdrawal, the statutory minimum period is 14 days from receipt of the product. Maison Nori’s commercial extension to 30 days does not reduce those statutory rights.
Return shipping costs resulting from a simple change of mind are borne by the customer where the customer was informed of this before purchase. Returns of defective or non-conforming products must not result in costs for the consumer.
12. STATUTORY GUARANTEES
Products sold to consumers benefit from the applicable statutory guarantees, including the statutory guarantee of conformity and the guarantee against hidden defects.
Within the European Union, goods sold by a professional benefit from a minimum two-year statutory guarantee where they are defective, non-conforming or do not match their description. Depending on the circumstances, the consumer may be entitled to repair, replacement, a price reduction or a refund.
These statutory guarantees apply independently of any commercial guarantee that may be offered.
13. AVAILABILITY AND CANCELLATION
Products are offered subject to availability.
If an item becomes unavailable after an order has been placed, Maison Nori will inform the customer as soon as possible and may offer:

a replacement product with the customer’s agreement;

an additional waiting period;

or cancellation and refund of the item concerned.
A cancellation request may be submitted before the order is processed or dispatched. Once the order has been processed or dispatched, the customer must follow the applicable return procedure.
14. INTELLECTUAL PROPERTY
All content on maison-nori.com, including texts, photographs, illustrations, logos, graphic elements, layouts and creative works, is protected by applicable intellectual property laws.
Any reproduction, adaptation, distribution, commercial exploitation or use without prior written authorization is prohibited, except where permitted by law.
15. REVIEWS AND CUSTOMER-SUBMITTED CONTENT
When a customer submits a review, photograph or other content to Maison Nori, they warrant that they have the necessary rights and that the content:

does not infringe the rights of any third party;

is not misleading, defamatory or unlawful;

does not contain personal data relating to a third party without their authorization.
Maison Nori may refuse or remove any content that is clearly unlawful or inappropriate.
16. LIABILITY
Maison Nori is responsible for the proper performance of its obligations in accordance with applicable law.
Maison Nori cannot, however, be held liable for damage resulting from:

abnormal or improper use of a product;

failure to follow usage or safety instructions;

negligence by the customer;

modification of the product by the customer;

an event of force majeure or another circumstance beyond its control.
Nothing in these terms limits any mandatory consumer rights or any liability that cannot legally be excluded.

Personal data is processed in accordance with the Privacy Policy published on the website.
It may in particular be used to:

19. FORCE MAJEURE
Maison Nori cannot be held liable for any delay or failure to perform resulting from an unforeseeable event or circumstance beyond its control, including a natural disaster, major transport disruption, strike, conflict, widespread network outage, administrative decision or exceptional disruption to supply chains.

21. CONSUMER MEDIATION
After first submitting a written complaint to Maison Nori that has not resulted in a satisfactory solution, the consumer may use consumer mediation free of charge.
22. GOVERNING LAW AND DISPUTES
These terms are governed by French law, subject to any more protective mandatory provisions that may apply in the consumer’s country of residence.
In the event of a dispute, the parties will first seek an amicable solution.
The consumer retains the right to bring proceedings before the competent courts in accordance with applicable legal rules. The choice of French law cannot deprive a consumer of mandatory protections available in their country of residence.
23. CHANGES TO THESE TERMS
Maison Nori may amend these terms to reflect legal, technical or commercial developments.
The version applicable to an order is the version published and accepted at the time the order is placed.
